The association's statutes are set out in its articles of association. The association offers advice on tenders for construction projects as a service. The range of services can be expanded at any time. The services are primarily aimed at experts, public clients, planning offices and building contractors.
A contract is concluded as soon as a written offer from the association is accepted by the customer or a written order confirmation is issued. Changes to the scope of services must be agreed in writing.
The association provides its services with due care, based on current technical and scientific knowledge. A specific outcome (e.g. winning a tender) cannot be guaranteed. The assignments are carried out by association members, with additional advice being sought if necessary.
The customer shall ensure that all relevant information, documents and data are provided in a timely and complete manner. The customer is responsible for the accuracy and completeness of this information.
Remuneration shall be in accordance with the quotation or order confirmation. All prices are exclusive of VAT. exclusive of value added tax, if applicable. In the event that no provision has been made, billing shall be based on actual expenditure at standard market hourly rates. The payment term is 30 days net, unless otherwise agreed. Interest on arrears and reminder fees may be charged in the event of late payment.
All services provided by the association are protected by copyright. The customer receives the simple, non-exclusive, non-transferable and non-sublicensable right to use the titles offered exclusively for their own purposes.
The association is only liable for damages caused intentionally or through gross negligence. Liability for auxiliary persons as well as consequential damages, lost profits or indirect damages is excluded. The association accepts no responsibility for incorrect results attributable to incomplete or incorrect customer data.
The customer agrees to the use of the data provided by them. All customer data will be treated confidentially and used exclusively for
Provision of the commissioned services. The association has published a privacy policy and complies with the applicable data protection laws of Switzerland (DSG) and, where applicable, the EU GDPR. Data will only be passed on to third parties with the express consent of the customer.
Both parties may terminate an order prematurely at any time. In this case, services already rendered must be remunerated in full.
Should individual provisions of the contract or the General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a legally valid provision that comes closest to the economic purpose of the invalid provision. The same applies if the contract or the General Terms and Conditions contain loopholes. Insofar as these General Terms and Conditions require the written form, this requirement may also be fulfilled by e-mail or any other form that can provide written proof. A signature by the parties is not required.
Swiss law applies. The place of jurisdiction is the registered office of the Swiss Building Simulation Association.
